1. About EquiCloset and These Terms
1.1 EquiCloset is an online peer-to-peer (C2C) marketplace operated by Charmaine Swinburn trading as EquiCloset (“we”, “us”, “our”). EquiCloset provides a technology platform where private individuals can list, buy, and sell preloved equestrian equipment including tack, rider clothing, and horse care products.
1.2 These Terms of Use (“Terms”) govern your access to and use of the EquiCloset website and related services (the “Platform”). They form a legally binding agreement between you and us.
1.3 Additional documents that form part of your agreement with us:

- Prohibited Items Policy — what cannot be listed on the Platform
1.4 These Terms are governed by the laws of England and Wales. If you are a consumer, nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or any other applicable legislation.
2. Who Can Use EquiCloset
2.1 To use EquiCloset you must be at least 18 years old. If you are aged 16 or 17, you may only use the Platform with the consent and supervision of a parent or guardian who accepts these Terms on your behalf.
2.2 EquiCloset is available to users in the United Kingdom only under these Terms. It is not available for international or cross-border transactions at this time.
2.3 By creating an account you confirm that: you are at least 18 years old (or have parental/guardian consent if aged 16–17); you are a resident of the United Kingdom; you have the legal capacity to enter into a binding contract under English law; all information you provide is truthful, accurate, and up to date; you are using EquiCloset as a private individual and not in the ordinary course of a business (unless you have entered into a separate commercial agreement with us).
3. Your Account
3.1 To buy or sell on EquiCloset, you must create an account. You agree to: provide truthful and accurate information when registering; keep your login credentials secure and confidential; notify us immediately at [email protected] if you suspect unauthorised access to your account; take responsibility for all activity that occurs under your account; maintain only one account at a time.
3.2 We may suspend or permanently close your account if we reasonably believe you have breached these Terms, provided false information, engaged in fraudulent activity, or engaged in conduct harmful to other users or to EquiCloset. See Section 12 for our enforcement process.
4. How the Marketplace Works
4.1 EquiCloset provides a technology platform and payment infrastructure. We do not buy or sell items ourselves, and we are not a party to any transaction between buyers and sellers. The contract for sale is between the buyer and the seller.
4.2 When a buyer purchases an item, the total payment (item price + Buyer Protection Fee + delivery charge) is held in a secure escrow account managed by our payment processor, Stripe. Funds are released to the seller once the buyer confirms receipt, or after the buyer protection window expires, whichever is earlier.
4.3 As a technology intermediary, EquiCloset does not own, inspect, verify, or endorse any items listed on the Platform. Buyers and sellers are responsible for the accuracy of listings and the condition of items.
4.4 EquiCloset earns revenue through the Buyer Protection Fee and the delivery charge. The delivery charge is paid by the buyer and used by EquiCloset to arrange and pay for the courier label, with a service element retained by EquiCloset. Neither the Buyer Protection Fee nor the delivery charge is deducted from the seller’s payout — both are collected from the buyer at checkout.
5. Buyer Protection Fee
5.1 Every transaction includes a Buyer Protection Fee, which is charged to the buyer at checkout and is separate from the item price.

5.2 The Buyer Protection Fee is calculated on the item sale price only, excluding the delivery charge.
5.3 The Buyer Protection Fee is non-refundable on completed transactions, except where we determine the sale was the result of buyer fraud, or where a refund is due under Section 8.
5.4 By paying the Buyer Protection Fee, you gain access to EquiCloset’s dispute resolution and refund process as described in Section 8.
6. Delivery and Postage
6.1 EquiCloset calculates the delivery charge from the parcel size and weight provided by the seller, using published courier rates, and adds a flat £1 platform service fee per order. The total delivery charge is shown clearly before you complete your purchase and is paid by the buyer. EquiCloset arranges and pays for the courier label; the delivery charge is not paid to the seller.
6.2 The delivery service element is collected by EquiCloset and is non-refundable on completed transactions, except as part of a refund under Section 8.
6.3 Sellers are responsible for packaging items securely and dispatching them within 3 business days of a sale being confirmed, using the delivery method paid for at checkout.
7. Payments
7.1 All payments on EquiCloset in the United Kingdom are processed by Stripe, an authorised payment institution. By making or receiving a payment on the Platform you agree to Stripe’s terms and conditions.
7.2 Funds paid by a buyer are held by Stripe until the transaction is marked as complete. Once complete, EquiCloset pays the seller directly by UK bank transfer (Faster Payments or BACS) to the bank account the seller has registered in their seller settings. Sellers do not need a Stripe account.
7.3 Strong Customer Authentication (SCA): Under UK payment regulations, you may be asked to verify your identity when making a payment. Transactions may be declined if authentication cannot be completed.
7.4 Seller Payouts: Sellers register their UK sort code and account number in their seller settings. Once a transaction is complete and the buyer protection window has passed, the seller requests a payout through their dashboard. EquiCloset reviews and sends payment by bank transfer, typically within 2 business days.
7.5 EquiCloset does not deduct any commission or platform fee from seller payouts. Stripe’s payment processing fee is deducted from the gross amount received before the seller’s net payout is calculated.
8. Buyer Protection
8.1 What Is Covered
Your Buyer Protection Fee entitles you to EquiCloset’s dispute resolution and refund process if: your item does not arrive and is confirmed lost in transit; your item arrives damaged in transit; your item is significantly not as described (SNAD) — meaning there is a material difference between the item received and its listing; your item is confirmed as counterfeit.
8.2 How to Make a Claim
You must report an issue within 48 hours of receiving our notification that your item has been delivered (or appears to be lost). Contact us at [email protected] with your order reference, a description of the issue, and supporting photographs. Our decision is final for the purposes of the EquiCloset platform, though your statutory rights are not affected.

8.4 When You Will Not Receive a Refund
You will not be eligible for a refund if you: fail to report the issue within 48 hours of delivery notification; have already confirmed receipt and that everything is satisfactory; used, washed, or altered the item before reporting the issue; cannot provide reasonable evidence to support your claim; made a purchase outside of the EquiCloset platform.
9. Your Obligations as a User
9.1 As a buyer, you agree to: pay the agreed total promptly; provide a correct and accessible delivery address; inspect items promptly on receipt and report any issues within the 48-hour window; act in good faith in any dispute.
9.2 As a seller, you agree to the additional obligations set out in our Seller Terms.
10. Prohibited Conduct
You must not: arrange payment for EquiCloset transactions outside the platform; list items prohibited under our Prohibited Items Policy; create false or misleading listings; make fraudulent buyer protection claims; use the platform’s messaging system to send spam or harassment; share personal contact details to circumvent the platform; use automated tools, bots, or scraping software; create multiple accounts; do anything illegal, deceptive, or harmful to other users.
11. Content and Intellectual Property
11.1 EquiCloset and its content (design, software, trademarks, domain name) are owned by Charmaine Swinburn t/a EquiCloset or its licensors. You may not copy, reproduce, or commercialise any part of the Platform without our prior written consent.
11.2 By uploading photos, descriptions, or other content (“your Content”) to the Platform, you grant us a non-exclusive, royalty-free licence to display, reproduce, and use your Content to operate and promote the Platform. This licence ends when you delete your Content or close your account.
11.3 You confirm that your Content does not infringe any third party’s intellectual property rights, and that you have the right to upload it.
12. Account Enforcement and Appeals
12.1 Corrective Actions
If we believe you have breached these Terms or acted harmfully, we may: issue a warning; remove specific listings or content; restrict your account; temporarily suspend your account; permanently close your account.
12.2 What Happens to Pending Transactions
If your account is suspended or closed: any in-progress transactions may be completed at our discretion; escrowed funds will be held until the transaction is resolved; we will not refund any platform fees already collected.
12.3 Appeals
If you believe an enforcement action was taken in error, you may appeal by emailing [email protected] with the subject line “Account Appeal” within 14 days. We will respond within 10 business days.
13. Our Liability
13.1 EquiCloset is a technology platform and marketplace intermediary. We are not liable for: the quality, safety, legality, or accuracy of any listed item; the ability of sellers to sell or buyers to pay; items lost or damaged in transit (though our Buyer Protection process may apply); any off-platform transaction.
13.2 Nothing in these Terms limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; any liability that cannot be excluded under the Consumer Rights Act 2015 or any other applicable law.
13.3 Subject to clause 13.2, our total liability to you in connection with the Platform will not exceed the greater of the value of the transaction giving rise to the claim or £100.
14. Disputes Between Users
14.1 If a dispute arises between a buyer and a seller, EquiCloset will attempt to mediate in good faith through our dispute resolution process. We may request evidence from both parties and will make a decision on the release of escrow funds. This decision is final for the purposes of the Platform.
14.2 EquiCloset’s mediation is not a substitute for legal proceedings. Either party retains the right to pursue a claim through the courts or an alternative dispute resolution scheme.
15. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or via a Platform notice at least 14 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
16. General
16.1 Entire agreement: These Terms, together with the Privacy Notice, Cookie Policy, Seller Terms (if applicable), and Prohibited Items Policy, constitute the entire agreement between you and us regarding use of the Platform.
16.2 Severability: If any provision of these Terms is found to be unlawful or unenforceable, that provision shall be limited to the minimum extent necessary so that the Terms shall otherwise remain in full force and effect.
16.3 Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
16.4 Governing law: These Terms are governed by the laws of England and Wales. Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales.
